COMINTY develops and operates the Cominty platform (the “Platform”), which enables businesses to ask specific questions to a chatbot.
COMINTY allows you to ask questions on specific topics to a conversational agent (the “ChatBot”). The ChatBot provides information formulated by artificial intelligence based on the Client's internal documents, information from the internet, and the fundamental knowledge of the artificial intelligence model used, in order to provide you with an answer. Depending on the question posed, COMINTY also offers the option to schedule a video conference appointment via the Platform (the “Call”), by sharing available time slots to discuss with qualified professionals.
Shortly after each Call, Users who participated in the Call will be notified that a Summary of the Call is available. They will be able to read, modify, and decide whether or not to share it with all other users using COMINTY within their company. If they decide to share it, the information in the Summary will be accessible through the ChatBot.
The Services are provided via the Platform.
At the end of the Call, you can evaluate whether the advice provided to your issue seems relevant.
You have access to the Platform as part of the contract entered into between COMINTY and your organization (the “Organization”), which enables you to benefit from our Services (the “License Agreement”).
These terms of use (“Terms”) grant an individual user (“User,” “you”) the right to access and use the Platform and Services under the license agreement concluded between your Organization and COMINTY.
To access our Services, your Organization must invite you to create an account on the Platform and complete the registration form provided on the Platform.
You must provide all information marked as mandatory.
Registration automatically results in the creation of an account in your name (the “Account”), which allows you to access our Services using your login credentials and password.
Once your Account has been created, you will have access to a personal space allowing you to manage the use of the Platform.
The Services you have access to are described in the License Agreement.
You can review the features of our Services directly on our Platform.
COMINTY reserves the right to offer any other Service it deems useful, in a form and with the functionalities and technical means it considers most appropriate to deliver such Services.
The ChatBot directs you to professional profiles likely to answer the questions posed.
You can only organize Calls with other Users linked to the same Organization.
Calls take place via video conference and are recorded. Based on this recording, a summary of these Calls is created through an artificial intelligence tool (the “Summary”). This Summary will be made available on the Platform as soon as possible.
You may cancel the Call at any time before it begins. Under no circumstances can we be held responsible for such cancellation. Similarly, we cannot be held responsible if another user does not attend the Call.
You have access to the Summaries of Calls conducted by other Users linked to the same Organization who have consented to share their Summaries.
When using the Platform, there are several potential data sources, which may be combined or used individually, to feed the ChatBot in order to formulate a response to your question.

The Services rely on the use of artificial intelligence systems in several ways:

We ensure that our use of artificial intelligence tools aligns with the commitments outlined in our AI Compliance Charter.
You may use our Services for the duration subscribed to by the Organization under the License Agreement.
You acknowledge and agree that if the Organization terminates its contract with us, your Account will be automatically deactivated, and you will no longer have access to the Services.
You can access our Services subject to the payment of the fee by your Organization in accordance with the License Agreement.
You benefit from a non-exclusive, personal, and non-transferable SaaS license to use the Platform for the duration specified in the article “How long do you have access to our services?”.
You are therefore prohibited from:
The Platform is our property, as are the software, infrastructure, databases, and content of any kind (texts, images, visuals, music, logos, trademarks, etc.) that we operate. They are protected by all applicable intellectual property rights or database producer rights in force. The license granted to you does not entail any transfer of ownership.
Consequently, all disassembly, decompilation, decryption, extraction, reuse, copying, and, more generally, all acts of reproduction, representation, distribution, and use of any of the elements comprising the Platform, in whole or in part, without our authorization, are strictly prohibited and may result in legal action.
The data provided by the Organization to feed the ChatBot remains the property of the Organization. These are protected by all applicable intellectual property rights.
However, for the proper functioning of the Services, the Organization expressly authorizes us to decrypt, extract, reuse, copy, and reproduce the data transmitted by the Client to feed the ChatBot.
At the end of the Calls, COMINTY's artificial intelligence generates a Summary, which becomes the exclusive property of your Organization once you consent to its publication on the Platform. You can provide your consent generally or on a case-by-case basis.
You also have the option to modify the Summaries.

By subscribing to the Services, you acknowledge that any content of any kind you publish on the Platform ("Content") is shared in the spirit of community exchange.
For a duration of 10 years from the signing of these Terms, you authorize us to use the testimonials you provide while using the Services ("Testimonials") for the promotion of the Platform under the following conditions:
Any testimonial containing personal data as defined by the General Data Protection Regulation (GDPR) may be subject to a request for the removal of such data, which can be notified via email to hello@cominty.ai.
We commit to making every effort to process your request promptly and within a maximum of 30 days.
As part of the promotional operations we may implement to promote our Services, you authorize COMINTY to capture, reproduce, disseminate, and communicate to the public, in part or in full, the attributes of your personality, namely your image, first name, and voice (the "Personality Attributes").
This authorization is granted for promotional and advertising purposes, on all media and by any methods, known or unknown to date, including:
This authorization is granted worldwide and for a duration of 10 years from the acceptance of the Terms. Any request for the removal of personal data as defined by the General Data Protection Regulation (GDPR) must be notified via email to hello@cominty.ai.
We commit to making every effort to process your request promptly and within a maximum of 30 days, noting that such a request must not disproportionately affect our commercial interests and will apply to future publications and distributions as well as past publications and media subject to reasonable modifications.
COMINTY undertakes not to exploit your Personality Attributes in a manner that could harm your reputation.
You are responsible for maintaining the confidentiality and security of your username and password.
Any access to the Platform using these credentials will be deemed to have been made by you. You must immediately contact us using the contact details provided in the article "Who are we?" if you discover that your Account has been used without your authorization.
You acknowledge that we have the right to take all appropriate measures to terminate such unauthorized use, including disabling or blocking the relevant Account. We commit to informing you of such actions promptly.
You commit to providing all necessary information for the subscription and use of the Services.
You are solely responsible for the information you provide during the Call. You agree not to disclose any confidential information. You acknowledge that, if applicable, such information may appear in the Summary. You release COMINTY from any liability concerning the dissemination of the Summary if it contains confidential information.
However, if you identify confidential information that you unintentionally shared in a Summary, you may inform us and request the removal of such confidential information via email athello@cominty.ai.We commit to making every effort to process your request promptly and within a maximum of 30 days.
You can feed the ChatBot by uploading documents directly to the Platform.
You expressly authorize this use of the data and documents that you provide to us.
You guarantee to COMINTY that the Organization holds all rights related to the documents and data provided. You ensure that these documents do not constitute an infringement and that their transmission does not violate the rights of any third party, in any capacity. More generally, you guarantee COMINTY that nothing prevents the free use of these documents and data by COMINTY.
You are responsible for how you use these documents and data that you provide to feed the ChatBot. We cannot be held liable in any way for this.
Consequently, you indemnify COMINTY against any legal action, claim, demand, or objection by any party asserting an intellectual property right or an act of unfair competition and/or parasitism to which this transmission of documents and data may give rise.
You are responsible for your use of the Services and for any information you share in this context, whether in the Call or in the documents and data provided to feed the ChatBot. You agree to use the Services personally and to not allow any third party to use them on your behalf or for your benefit.
You commit to alerting us of any attack, potential threat, or attempted intrusion by third parties into your Account.
You are prohibited from misusing the Services for purposes other than those for which they were designed, including:

You are responsible for all Content of any kind (editorial, graphic, audio, audiovisual, or otherwise) that you publish and/or exchange in connection with your use of the Platform and the Services.
You accept that the Content shared on the Platform is, by default, made public and may be visible to other users of the Platform.
You commit to ensuring that the Content you publish is lawful, does not violate public order, morality, or the rights of third parties, does not breach any legislative or regulatory provisions, and, more generally, cannot lead to COMINTY being held civilly or criminally liable.
You are prohibited from publishing any Content that:
We act as a hosting service provider for the content exchanged via the Platform and published on the Platform. Consequently, we are not responsible for such content.
If we receive a notification about clearly unlawful content, we will act promptly to remove it or make it inaccessible and may take the measures described in the article “What are the penalties for breaching your obligations?”
You are responsible for the relationships you establish with other users of the Platform. You agree to act with discretion and to respect standard rules of politeness and courtesy in your interactions with other users.

Without prejudice to other obligations outlined in these terms, we commit to providing the Services with diligence and in accordance with industry standards, it being specified that our obligation is one of means and not of result, which you expressly acknowledge and accept.
We specifically commit to conducting regular checks to ensure the proper functioning and accessibility of the Platform. In this respect, we reserve the right to temporarily suspend access to the Platform for maintenance purposes.
However, we are not responsible for temporary difficulties or impossibilities in accessing our Services that arise from:

We do not provide any guarantee regarding the quality or accuracy of the information provided during the Calls.
We ensure that sufficient storage capacity is made available for the operation of the Services.
We make our best efforts to ensure the security of data by implementing measures to protect infrastructure and the Platform, detect and prevent malicious acts, and recover data.
All of our guarantees and responsibilities are detailed in the License Agreement.
In connection with the Services, we process your personal data as a data controller within the meaning of applicable data protection regulations. Our privacy policy is accessible on our website.
We commit to ensuring, under an obligation of means, the hosting of any content you may publish on the Platform in accordance with industry practices and the state of the art, either on our own servers or via a professional hosting provider operating in compliance with industry standards and the state of the art.
We commit to providing sufficient storage and processing capacities as part of the Services, in compliance with industry standards and the state of the art.
We commit to implementing all technical measures, compliant with the state of the art, necessary to ensure the security and access to the Services, including the protection and monitoring of infrastructure, control of physical and/or digital access to such infrastructure, as well as the implementation of detection, prevention, and recovery measures to safeguard servers from malicious acts.
We also commit to taking all necessary precautions, considering the nature of the data and the risks posed by automated data processing carried out for the Services, to preserve data security, and in particular to prevent data from being altered, damaged, or accessed by unauthorized third parties.
Aside from technical assistance, any anomaly detected by the User must be reported to the Organization, which will handle the issue directly with us.
We provide technical assistance accessible via email at the address indicated in the article “Who Are We?” This allows you to report any difficulties encountered while using the Services. The technical support service is available from Monday to Friday, excluding holidays or public holidays, from 9:00 AM to 6:00 PM.
We cannot be held liable for the technical availability of websites or mobile applications operated by third parties (including our potential partners) that you may access through the Platform.
We assume no responsibility for the content, advertisements, products, and/or services available on such third-party websites and mobile applications, which are governed by their own terms of use.
We are not responsible for transactions between you and any advertiser, professional, or merchant (including potential partners) to whom you may be directed through the Platform, and we shall not be party to any disputes you may have with these third parties concerning, in particular, the delivery of products and/or services, warranties, representations, or any other obligations these third parties may be subject to.
You expressly acknowledge and accept:
You may unsubscribe from the Platform at any time by submitting a request directly to your Organization. Once unsubscribed, you will no longer have access to your Account or the Services.
At the Organization's request, we may unsubscribe you at any time. In such a case, you will no longer have access to your Account or the Services.
The obligations outlined in the article “What Are Your Obligations and What Are You Responsible For?” are essential obligations.
In the event of a breach of your obligations, we may:
These penalties are without prejudice to any damages and compensation that we may claim from you.
We may modify our Terms and Conditions at any time and will notify you by any written means (including via email). If you continue to use our Services after the modified Terms and Conditions take effect, we will consider that you have accepted them.
If you do not accept these modifications, you must terminate the Services in accordance with the procedures outlined in the article “How to Terminate the Services?”
Our Terms and Conditions are governed by French law.
In the event of a dispute between the parties regarding the validity, interpretation, or execution of these Terms and Conditions, the parties will endeavor to resolve their dispute amicably. Failing an agreement within one month following the first written notification by one party to the other concerning the dispute, the matter will be submitted to the exclusive jurisdiction of the courts of Paris (France), including in the event of multiple defendants or third-party claims.
